Any claim relating to Diligence Media website shall be governed by the laws of the UK without regard to its conflict of law provisions. General Terms and Conditions are applicable to the Use of a Website.

Section 1.0 – Global Payment Terms

Payment Terms

All invoices have the payment term ” Net 14 ” which means invoices are required to be paid within 14 days of the invoice date.

Late Invoice Payments

Any invoice that isn’t paid within the net 14 (within 14 days of the invoice date), will see its invoice payment increase by 10% compound weekly. 

Urgent Work

Any work sent on the day, needing to be done on the same day will have a 25% increase in payment. 

Section 2.0 – Podcasts

Paying for Episodes

If you bulk buy podcasts, you’re paying for the amount that’s stated.

There are two pricing structures for paying for episodes.

Pricing Structure #1

Through the website, you can pay upfront for the episodes, per episode or in bulk.

It’s a quick and easy process whilst being secure.

Pricing Structure #2

Invoicing.

If you would prefer an invoice, instead of purchasing through the website, this will be sorted out. Send us an email below.

If you were to choose the invoice route, you have two options. Whether you’re buying a singular episode or in bulk, you can either pay upfront for all the episode(s). Or, get charged for an episode upon completion. We’re happy with both, it’s all down to you.

Here’s an example of paying for an episode upon completion.

So let’s say you bulk-buy 10 episodes at the smaller duration (£550) but you don’t want to pay upfront. Week 1, you send us 2 episodes. We’ll get these done, and then invoice you at the discounted rate of £110. Week 2, you send us 5 episodes. We’ll complete these and then invoice you at the discounted rate of £275.

For each bulk-purchase package, we have a time limit.

At any duration, if you chose our 5-episode bulk package, there is an 8-week time limit. This means if you only send us 3 episodes within that 8-week time limit. You will get charged for the remaining episodes, in this case, you will get invoiced £120.

At any duration, our 10-episode bulk package has a 15-week time limit.

Paying for Episodes

If you bulk buy podcasts, you’re paying for the amount that’s stated.

Paying for Launch Packages

Launch Packages can be paid in two ways.

  1. You pay upfront for the whole launch package.
  2. You pay 50/50. 50% of the launch package price before any work has started, then a further 50% after the work has been completed.
Paying for Sub-Services (Graphic Design, Video Editing, Transcribing, Podcast Management)

These services are to be paid monthly via Direct Debit,

Section 3.0 – Websites

Paying for Web Development

All Web Development packages can be paid in two ways.

  1. You pay upfront for the whole website.
  2. You pay 50/50. 50% of the website price before any work has started, then a further 50% after the work has been completed.


Re-Adjustment to the Initial Quote

Our initial estimate for the quote made by us, the company. Has the right to change if you, the client, require further work that was outside of the initial quote at the start of the project. Any changes to quotes will be sent to you via email.

Failure to provide required website content

Diligence Media is a small business, and to remain efficient we must ensure that the work we have programmed is carried out at the scheduled time. On occasions, we may have to reject offers for other work and enquiries to ensure that your work is completed at the time arranged.

This is why we ask that the Client provides all the required information in advance. On any occasion where progress cannot be made with the Client’s website because we have not been given the required information in the agreed time frame, and we are delayed as result, we reserve the right to impose a surcharge of up to 25% of the Charges.

If the Client agrees to provide us with the required information and subsequently fails to do within 10 days of project commencement we reserve the right to close the project and the balance remaining becomes payable immediately. Simply put, do not give us the go ahead to start until you are ready to do so.

Using our content management system the Client is able to keep your content up to date itself.

Access Requirements

If the Client’s website is to be installed on a third-party server, Diligence Media must be granted temporary read/write access to the Client’s storage directories which must be accessible via FTP. Depending on the specific nature of the project, other resources might also need to be configured on the server.

Domain Names, Website Hosting & Other Subscription Services

Diligence Media may purchase domain names, website hosting or other subscription services, on behalf of the Client. Payment and renewal of those domain names, website hosting, and other subscription services is the responsibility of the Client. The loss, cancellation or otherwise of the domain name, website hosting or other subscription services, brought about by non or late payment is not the responsibility of Diligence Media. The Client should keep a record of the due dates for payment to ensure that payment is received in good time. Any time a direct debit is cancelled with consultation with us, your service will be cancelled. For example, if you subscribe to Web Hosting for your website, you cancel your subscription, we’ll remove you from our server.

Paying for Sub-Services (Web Hosting, Analytics, Email Marketing)

These services are to be paid monthly via Direct Debit.

Termination

Termination of services by the Client must be requested in a written notice and will be effective on receipt of such notice. E-mail or telephone requests for termination of services will not be honoured until and unless confirmed in writing. The Client will be invoiced for project work completed to the date of first notice of cancellation for payment in full within fourteen (14) days.

If the client has paid in advance, no refunds will be issued for the project work which has already been completed to the date of the first notice of cancellation or termination.

Termination of services by the Client may also incur additional charges, such as: the cost of transferring website hosting, domain names or other services away from Diligence Media, to another provider.
